Terms of service

By downloading, installing, or using the Shouty mobile application, you agree to be bound by these terms of service. If you do not agree to these terms, do not use the app.

Shouty: Say it bigger. Some things are easier to show than to shout. Shouty turns your phone into a bright, scrolling LED sign that can be read from across a stadium, a station concourse, or a dark parking lot.

You must be at least 13 years of age to use the app. By using the app, you represent and warrant that you meet this requirement.

Where the app offers sign-in, you are responsible for maintaining the security of your account and for all activity that occurs under it. You must not use another person's account without permission.

You agree not to:

• Use the app for any unlawful purpose.
• Attempt to gain unauthorized access to any part of the app or its backend systems.
• Interfere with or disrupt the integrity or performance of the app.
• Reverse engineer, decompile, or disassemble any part of the app.
• Use the app to transmit harmful, offensive, or abusive content.

Shouty makes text extremely visible in public places. That is its entire purpose, and it carries real-world responsibility. You are solely responsible for what you display and where you display it, and you agree not to use Shouty to:

• Harass, threaten, intimidate, defame, or bully any person.
• Display hate speech, or content targeting people on the basis of race, ethnicity, religion, disability, gender, sexual orientation, or any protected characteristic.
• Display obscene or sexually explicit content where it may be seen by minors.
• Impersonate any person or organisation.
• Distract, obstruct, or endanger drivers, pilots, machine operators, or anyone whose attention affects the safety of others.
• Interfere with emergency services, law enforcement, medical personnel, or public safety operations.
• Violate venue rules, local ordinances, or any applicable law.

Shouty can display bright, rapidly scrolling, high-contrast content and can raise your screen to maximum brightness. If you have photosensitive epilepsy or any condition triggered by flashing or moving imagery, use caution or do not use this app, and discontinue use immediately if you experience dizziness, disorientation, altered vision, or involuntary movement. Never use Shouty while driving or operating a vehicle. Extended use at high brightness will consume battery quickly and may warm your device, and you are responsible for keeping physical control of your phone while displaying a sign.

You agree to indemnify and hold us harmless from any claim arising out of your use of the app, your violation of these terms, or your violation of any right of a third party, including any claim arising from content you chose to display in public.

These terms are between you and us, not Apple. Apple has no obligation to provide support for the app, and is not responsible for any product warranty claim, product liability claim, or third-party intellectual property claim relating to it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

You retain ownership of the content you create in the app. By using the app, you grant us a limited, non-exclusive license to store and display that content solely to provide the service to you. We do not claim ownership of your personal data.

The Shouty name, logo, design, and all related content are the intellectual property of the developer and are protected by applicable copyright and trademark laws. You may not copy, modify, or distribute any part of the app without prior written consent.

If you enable notifications, you consent to receiving push notifications from the app. You can disable them at any time via your device settings.

We reserve the right to suspend or terminate your access to the app at any time, without notice, if you violate these terms or engage in conduct we determine to be harmful to the app or its users. You may delete your account at any time; upon deletion, all your data is permanently removed.

The app is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including uninterrupted or error-free operation, fitness for a particular purpose, or accuracy of any content.

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the app, even if we have been advised of the possibility of such damages.

We may update these terms from time to time and will note significant changes by updating the "last updated" date. Continued use of the app after changes constitutes acceptance of the new terms.

These terms are governed by and construed in accordance with the laws of India, without regard to its conflict-of-law provisions.
